An Act
To assure safe and healthful working conditions for working men and women; by authorizing enforecement of the standards developed under the Act; by assisting and encouraging the States in their efforts to assure safe and healthful working conditions; by providing for research, information, education, and training in the field of occupational safety and health: and for other purposes.
Be it enacted by the Senate and the House of Representatives of the United States of America in Congress assembled. That this act may be cited as the "Occupational Safety and Health Act of 1970."
SEC. 5. Duties
(a) Each employer --
(1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;
(2) shall comply with occupational safety and health standards promulgated under this Act.

(b) Each employee shall comply with occupational safety and health standards and all rules, regulations, and orders issued pursuant to this Act which are applicable to his own actions and conduct.
SEC. 17. Penalties
(a) Any employer who willfully or repeatedly violates the requirements of section 5 of this Act, any standard, rule, or promulgated pursuant to section 6 of this Act, or regulations prescribed pursuant to this Act, may be assessed a civil penalty of not more than $70,000 for each violation, but not less than $5,000 for each willful violation.

106.8. Flammable liquid means any liquid having a flash point below 100 F (37.8C) or higher, the total of which make up 99 percent or more of the total volume of the mixture. Flammable liquids shall be known as Class I liquids. Class I liquids are divided into three classes as follows:
Class IA shall include liquids having flash points below 73F (22.8C) and having a boiling point below 100F(37.8C).
Class IB shall include liquids having flash points below 73F (22.8C) and having a boiling point at or below 100F(37.8C)
Class IC shall include liquids having flash points at or above 73F(22.8C) and below 100F(37.8C).
It should be mentioned that flash point was selected as the basis for classification of flammable and combustible liquids because it is directly to a liquid's ability to generate vapor, ie., its volatility. Since it is the vapor of the liquid, not the liquid itself, that burns, vapor generation becomes the primary factor in determining the fire hazard. The expression "low flash - high hazard" applies.
Liquids having flash points below ambient storage temperatures generally display a rapid rate of flame spread over the surface of the liquid, since it is not necessary for the heat of the fire to expend its energy in heating the liquid to generate more vapor.
